Learning Objectives

After completing this session, participants will be able to:

  • Identify the main causes of disputes within the construction industry.
  • Differentiate among various dispute resolution techniques commonly used in construction projects.
  • Explain the purpose, structure, and processes of dispute boards, including how they support dispute avoidance and facilitate timely resolution of ongoing issues.

Program Description

This session provides an overview of the primary factors that lead to disputes in the construction industry and examines commonly used dispute resolution methods. The course will also explain the structure and function of dispute boards, including how they help prevent issues from escalating and how they facilitate timely resolution when disputes arise.

CPE Credit

This course qualifies for Continuing Professional Education (CPE) credits and is compliant with standards set forth by the National Association of State Boards of Accountancy (NASBA). 

Participants in this course are eligible to receive up to 1.0 Continuing Education Credits (CPE’s) to fulfill professional accreditation requirements.

Tarek El-Sewafy is an Ontario-based commercial and contracts leader specializing in procurement strategy, contract governance, change management, and claims/dispute resolution. As Commercial and Contracts Director at Constrata Consultants, he supports clients and project teams in making clear, defensible contractual decisions and managing risk across the project lifecycle. He has held senior roles on major infrastructure programs, including a power plant, cement plant and an LRT project of approximately valued at about CAD 13B, supporting contract interpretation, performance metrics, and claims strategy. He holds M.Sc., MBA, PMP, PQS, and MCIArb credentials and is an LLM (Dispute Resolution) candidate at Osgoode Hall Law School.
